It will still work exactly the same with the older firmware except on Pi 4 and lower you will have slower neural network upload speeds.Is it absolutely necessary to upgrade the firmware or will the camera still work if you don't ?

For non-approved resellers, we have no say on their terms and conditions, you will have to get in touch with them to find their returns/replacement policy. Did you buy a device from a non-approved reseller? If so which one? How many did you purchase?
No.Is there really no way to unbrick the camera if it gets bricked, no way to reload the RP2040 with camera firmware ? Are there no test pads which would allow that ?
This is because of a mixture of technical and non-technical reasons which I'm not going to get into.I am also wondering why the same approach to making the RP2040 on the Build HAT unbrickable wasn't used here ? That would have allowed this update, and any future updates, much safer to attempt.
